Stage two: visa availability — the fork in every timeline
Immediate relatives of a U.S. citizen — spouse, unmarried under-21 child, parent — skip this stage: a visa is always available. Every other family category waits under the monthly Visa Bulletin for its priority date to come current. Stage three: adjustment or consular processing
With a visa available, the case forks on the beneficiary's location and manner of entry — a case-by-case question. Beneficiaries in the United States after a lawful entry may be able to file Form I-485 and adjust status; while an I-485 is pending, they may also apply for employment authorization (Form I-765 — $260 under the current schedule when filed with a post-April-2024 I-485) and advance parole travel permission (Form I-131).
